3. How We Respond to DMCA Notices

3.1 Review

Upon receipt, we will verify that the notice satisfies all DMCA requirements. Incomplete or bad-faith notices will not be acted upon.

3.2 Preliminary Action

For valid notices, we will take appropriate action within 1–3 business days, which may include disabling access to or removing the identified content.

3.3 Notification to Alleged Infringer

We will notify the associated user that a DMCA notice was received and that action was taken. The user may submit a counter-notification if they believe the takedown was made in error.

3.4 Repeat Infringer Policy

We reserve the right to terminate the accounts of users found to be repeat infringers, at our sole discretion.

4. Counter-Notification Procedure

If your content was removed and you believe this was a mistake or misidentification, you may submit a written counter-notification. Your counter-notification must include:

  • Your electronic or physical signature
  • Identification of the removed material and its former location on the Service
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification
  • Your full name, mailing address, telephone number, and email address
  • A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Wyoming if your address is outside the United States), and your agreement to accept service of process from the original complainant

Upon receiving a valid counter-notification, we will:

  • Forward the counter-notification to the original complainant
  • Inform the complainant that we will restore the removed content within 10–14 business days unless the complainant notifies us of a court action
  • Restore the removed content within 10–14 business days, provided we have not received notice of a court action from the original complainant

5. Good Faith and Abuse

Submitting a DMCA notice or counter-notification that contains materially false information or is made in bad faith may give rise to civil liability under 17 U.S.C. § 512(f). We reserve the right to disregard any notices that appear to be intended to suppress lawful content.
